OFFICIAL CITY OF ASBURY, IOWA WORK OF THE COUNCIL Regular meeting: 12/14/21 Council met at 7:00 pm The regular meeting of Asbury Town Council was opened by Mayor Adams. In attendance: Board members Domeyer, Kiessling, Miller, Reisch and Richey. This meeting was held face-to-face and via zoom. On motion, the consent agenda was approved. Public hearing on the draft Necessity Resolution for the Springree Reconstruction Project n Drive South and Sunset Drive. On motion, the public hearing was opened at 7:07 p.m. and interested parties were heard for or against the draft resolution of necessity. (Unanimous) On motion close the public hearing at 7:39 p.m. (Unanimous) On motion approved resolution 258-2021, a resolution amending the resolution of necessity for the Springreen Drive South and Sunset Drive reconstruction project to be built without sidewalks or retaining walls. Motion carried. (3 yes and 2 no) On motion, resolution # 258A-2021 was approved, a resolution approving the resolution of necessity for the Springreen Drive South and Sunset Drive reconstruction project to be built without sidewalks or retaining walls. The movement fails. (3 yes and 2 no) Public hearing on the proposed modification of the Asbury urban renewal area. On motion, it was moved to open the public hearing at 8:44 p.m. and hear interested parties for or against the proposed change to the Asbury Urban Renewal Area. (Unanimous) On motion, closure of the public hearing at 8:45 p.m. (Unanimous) On motion approved resolution n ° 260-2021, a resolution to approve the modification of the urban renewal plan for the urban renewal area of Asbury. (4 yes and 1 no) Public hearing on the plans, specifications, form of contract and cost estimate proposed for the Cloie Creek trail project. On motion opened the public hearing at 20:49 and hear interested parties for or against the proposed project. (Unanimous) On motion close the public hearing at 8:49 p.m. (Unanimous) On motion approved resolution n ° 261-2021, a resolution approving the plans, specifications, form of contract and cost estimate for the Cloie Creek trail project . (Unanimous) On motion approved, Resolution # 262-2021, a resolution to review the offers for the Cloie Creek Trail. (Unanimous) Public hearing on the modification of the city limits. On motion opened the public hearing at 20:53 and hear interested parties for or against the boundaries of the enclosure. (Unanimous) On motion to close the public hearing at 8:54 pm (Unanimous) On motion proposed to adopt Ordinance 8-2021, an ordinance amending the Code of Ordinance, City of Asbury, Iowa, Chapter 6 “Elections” Section 6.07 repealing the provisions incompatible with it. (Unanimous) On motion, it was moved that the statutory rule requiring that the said ordinance be considered and voted for adoption at three meetings of the council before the meeting at which it is finally to be adopted be suspended. (Unanimous) On a motion proposed to finally adopt and adopt Ordinance No. 8-2021. (Unanimous) On motion approved resolution n ° 263-2021, a resolution approving payment request n ° 1 for the 2021 sludge removal project. (Unanimous) On motion approved resolution n ° 264-2021, a resolution Approving the Certificate of Substantial Completion, Declaration of Final Completion and Owners’ Acceptance of Completed Work on the 2021 Sludge Disposal Project. (Unanimous) On motion, Resolution No. 265-2021 was approved, a resolution approving Change Order # FINAL for the Clover Lane Asphalt Paving Project. (Unanimous) On motion, resolution # 266-2021 was approved, a resolution to approve payment request # FINAL for the Clover Lane Asphalt Paving Project. (Unanimous) On motion, Resolution No. 267-2021 was approved, a resolution approving the Certificate of Substantial Completion, the Declaration of Final Completion and the acceptance by the owners of the work carried out on the paving project of asphalt Clover Lane. (Unanimous) On motion approved, resolution n ° 268-2021, a resolution setting the date of the public hearing as 1/11/2022 at 7:00 p.m. for the amendment to the budget for fiscal year 2022. (Unanimous) On motion , the following reports were approved: 1) Police report and 2) Golf report from general managers.
